Terms and Conditions: AweSIM cellular data service

These Terms and Conditions (“Agreement”) govern the use of the AweSIM data plan (“Service”) offered by Purism (referred to as “we,” “us,” or “our”) to you (“Customer” or “you”).
By subscribing to the AweSIM (comprising AweSIM, SIMple Plus, and SIMple) Service, you acknowledge and agree to be bound by these terms.
It is essential that you read and understand this Agreement before subscribing to the Service.

1. Financing Agreement

1.1 By subscribing to the Service, you agree to make fixed monthly payments for a minimum duration of one month (“Payment Period”).
The billing cycle for the Service is on a recurring monthly basis, commencing on the date of subscription.
1.2 The fixed monthly payment includes the data plan service for the duration of the Payment Period.
1.3 After the Payment Period expires, the data plan service will be automatically charged at the full rate unless you migrate to a different plan or terminate the service (as outlined in section 4).
1.4 You hereby authorize Purism to charge your chosen payment processor for fixed monthly payments during the Payment Period.
You agree to make full payment for the Service within 7 days of the monthly billing cycle.
Failure to pay the billed amount within the specified time may result in service interruption or termination without notice.

2. Service Activation

2.1 Data plan service will not be activated until the Customer receives the AweSIM package containing the SIM, and requests activation of the SIM.
2.2 All data plan activation correspondence shall be communicated through the appropriate channels, as described in the documentation included with the Service.
2.3 Failure to provide an activation notice within 10 business days of receipt of the Service will not alter the recurring charges of the Service.

3. Early Cancellation

3.1 If Service membership is terminated prior to the completion of the Payment Period, the Customer is still subject to paying the remainder of the invoice for that Payment Period.
3.2 There are no early cancellation charges or prorated refunds for early cancellation.

4. Refunds and RMAs

4.1 Refunds for the Service abide by Purism’s posted Refund Policy.
4.2 RMAs will be issued for products as described in the Hardware Warranty Policy.
4.3 Data plan services will still be charged for the remainder of the active billing cycle, but will not be renewed.
4.4 The Customer is responsible for requesting any phone number port-out transfers within this time.

5. Service Adjustments

5.1 Following Initial Payment Period

5.2.1 Following the initial Payment Period of Service activation, the Customer may terminate or adjust the service plan by providing written notice at least 30 days prior to the next renewal date.
5.2.2 Failure to comply with service adjustment notification within the specified timeframe will cause the data plan service to continue as-is and be charged the full rate of the data plan at the time of renewal.

6. Transferring an Existing Number

6.1 The Customer may transfer an existing number to or from AweSIM services by following the porting process as outlined by Purism.
6.2 Transferring a number to AweSIM services is an extra charge not included in the Service.
6.3 Purism is not liable for any issues or delays that may arise during the number transfer process, including any loss or interruption of service during the transition.
6.4 The Customer understands that transferring an existing number may require the cancellation of services with the active provider, which may incur additional charges.

7. Usage Restrictions

7.1 The Service is intended for personal or commercial use only and is not permitted for resale.
7.2 The Customer agrees not to use the Service in a manner that infringes upon the rights of others or violates any applicable laws or regulations.

8. Privacy and Data Protection

8.1 Purism will handle your personal information in accordance with the Privacy Policy, which is available on the Purism website.
8.2 By subscribing to the Service, the Customer consents to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

9. Limitation of Liability

9.1 Purism shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from the use or inability to use the Service.
9.2 Our liability, if any, shall be limited to the amount paid by you for the specific Service.
9.3 These Terms and Conditions constitute the entire agreement between you and Purism, superseding any prior agreements or understandings, written or oral.
9.4 Purism reserves the right to modify or replace these Terms and Conditions at any time.
Any published modifications will be effective immediately for any and all subsequent Service subscriptions.
9.5 If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
9.6 Any failure by Purism to enforce any right or provision of these Terms and Conditions will not constitute a waiver of such right or provision.

10. User Agreement

10.1 By subscribing to the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
Failure to comply may result in the termination of our services without notice.
If you do not agree with any part of these Terms and Conditions, please do not subscribe to the Service.
